Is it legal to drive someone else’s car without insurance in Spain?
Understanding the rules, risks and penalties around driving other people’s vehicles
There are times when it makes sense to let someone else drive your car or borrow a friend’s vehicle if you don’t have one. But in Spain, driving without insurance is illegal and can result in fines up to €3,000 and potential confiscation of the vehicle.But the good news is that Spanish car insurance is vehicle-specific, not driver-specific. This means that anyone with the car owner’s permission and a valid driver’s licence can legally drive the car, provided they don’t break the policy terms.
For occasional use, most family or friend policies cover any driver, unless restrictions apply - usually for new drivers or those under 25, who are seen as higher risk by insurers.
If you plan to drive someone else’s car regularly, it’s best that the insurance holder adds you as a named driver. Failing to do so risks having claims denied if an accident occurs.
New drivers, for insurance purposes, are considered novices for two years after getting their licence. They start with 8 points and must display an “L” plate for their first year. Additionally, insurers often charge higher premiums for “young drivers” under 25, viewing them as a greater risk on the road.
Driving without insurance can bring hefty fines ranging from €601 to €3,005. The exact amount depends on factors like whether the vehicle was in use, the type of vehicle, any patterns of repeat offence, and the severity of damage caused. Uninsured drivers or car owners are also personally liable for damages to third parties if an uninsured vehicle causes an accident.
To avoid issues if stopped by police, it’s wise to carry a document from the vehicle owner confirming you have permission to drive the car. This helps prove you’re authorised, especially if you’re not named on the policy.
At the end of the day, keeping insurance policies up to date and making sure all regular drivers are declared can save a lot of trouble down the road. It’s a legal requirement, and a practical safeguard, that benefits everyone on the road.
